Terms and Conditions

 

1. Daily/Hourly rate.

All fees may only be negotiated by Story Model Management Limited (“STORY”) on behalf of the artist/model (“Talent”) and are based on the quoted daily or hourly rate. Extra half hours or parts of half hours are payable at half the hourly rate. With the exception of “Equity” contracts, a day booking is for an eight (8) hour period, including a one (1) hour lunch break (Shops Act 1950). VAT and expenses will be added where appropriate.

2. Overtime.

Overtime rates will apply before 0900 hours, after 1800 hours and on all bookings in excess of eight (8) hours, as follows:
a. Between 1800 and 2400 hours, the overtime rate is 1½ times the normal hourly rate;
b. Between 2400 and 0900 hours, a special rate will be negotiated for night work.
c. Work on Saturdays will be charged at 1½ times the normal rate.
d. Work on Sundays and Bank Holidays will be charged at double the normal rate.

3. Usage.

Fees quoted are for the UK only, for three (3) months from the date of the booking (see paragraph 4 hereof), unless otherwise specified. An additional rate is payable for any use of photographs, or reproductions or adaptations thereof, or drawings therefrom, either complete or in part, alone or in conjunction with any wording or drawings. The “Usage” must be explicitly granted (as agreed on our confirmation of booking form and also specified on the relevant invoice – N.B. one image only may be used, unless otherwise agreed in writing) and defines the TYPE of usage, together with the TERRITORIES in which such usage is permitted and the DURATION of such usage. Under no circumstances will the basic usage fee be less than the Talent’s advertising day rate. All fees must be paid PRIOR to any use of photographs for any purpose whatsoever. Usage fees remain payable, even in the event that the Usage purchased is not actually exercised.

4. Additional Usage.

An additional rate is payable for any additional (e.g. additional TYPES of usage, additional TERRITORIES or extended DURATION) Usage of the photographs, or reproductions or adaptations thereof, or drawings therefrom, either complete or in part, alone or in conjunction with any wording or drawings, other than Usage already agreed (“Additional Usage Rate”). The CLIENT is responsible for notifying STORY of any additional Usage requirement and negotiating (only with STORY) the Additional Usage Rate payable in respect of such additional Usage, PRIOR to any such additional Usage taking place.

5. Travel.

Travel time is charged at 50% of the hourly rate. This applies to any travel outside a five mile radius of Hyde Park Corner (i.e. Chiswick in the west, Golder’s Green and Highgate Village in the north, Mile End in the east; and Streatham Hill and Tooting Bec in the South).

6. Insurance.

It is a material term of the booking that the client shall effect and maintain suitable insurance policies, including but not limited to: (i) cancellation insurance to protect against the cancellation of the assignment; (ii) liability insurance covering injury to or death of the Talent during the course of his or her assignment with you; and (iii) travel insurance to cover the Talent whilst travelling to and from the assignment.

7. Health & Safety.

If you are aware of any Health & Safety risks that the Talent may be exposed to during the course of his or her assignment with you, you must inform STORY in writing immediately, detail what the risks are and the steps you have taken to prevent or control these risks. If for any reason the Talent is injured or falls ill whilst travelling to or during the course of his or her assignment with you such that the Talent cannot take part in or complete the assignment, STORY and/or the Talent shall not be liable for any costs incurred by you in connection with or arising out of the assignment or any re-booked assignment.

8. Invoicing.

AIl fees and expenses, plus VAT (where applicable) shall be invoiced by STORY. Under no circumstances are payments to be made directly to the Talent, unless by prior written agreement with STORY. STORY reserves the right to invoice the ultimate client (i.e. designer/manufacturer/owner of the product/service in question). Fees for STORY’s services are charged and are included in the total charge (as detailed on the invoice) and VAT is chargeable on those fees (where applicable).

9. Payment.

All invoices are payable within thirty (30) days or prior to the commencement of Usage (see section4), whichever is the sooner. STORY understands and will exercise its statutory right to claim interest and compensation for debt recovery costs under the late payment legislation if invoices are not paid according to agreed credit terms.

10. Meals.

The Client is responsible for the provision of all meals and beverage requirements of the models (taking into account dietary requirements) whilst the models are providing services to the Client on all bookings.

11. Model Care & Safety.

Bathing suit, lingerie, semi-nude and see-through photography require the express prior written approval of the agency. The use of the Model’s image must not be pornographic, derogatory, or a cause of ridicule or embarrassment to the model. The image must not be altered or distorted.
a. Subject to the above restrictions, behind-the-scenes filming is permitted on condition that the Model is hair-and-make-up ready. The Clients shall ensure that the Model is treated with respect and professionalism and that the Client takes all steps necessary to ensure that the safety, health and wellbeing of the Model is protected and maintained at all times whilst providing services to the Client. Such steps shall include without limitation:

b. ensuring that the venue for the provision of the services and the working conditions are safe and secure and allow the Model to provide the services in compliance with all health and safety standards, regulations, codes and laws;
c. allowing the Model to take suitable and regular rest periods, to ensure the Model is able to maintain suitable amounts of rest and refreshment whilst delivering the services;

d. providing the Model with an appropriate changing and dressing area to ensure that the Model can prepare for the provision of the services and also maintains his/her privacy.
e. providing adequate levels of insurance cover to safeguard the health and safety and future earnings of the Model whilst the Model is delivering the services and travelling to and from the Client’s venue as if he/she were an employee of the Client;
f. ensuring that all of the people and organisations which are engaged by the Client in relation to the delivery of the services are suitably qualified, experienced and professional;
g. ensuring that no one imposes upon the Model any action or activity which is either dangerous, degrading, unprofessional or demeaning to the Model;

12. Exclusion Fees.

A special fee must be negotiated where work is in conjunction with a product which precludes work for competing products. It is the CLIENT’S responsibility to check whether conflicting work has been done. If a Talent advertises a product he/she is able to work for any competitor unless an “Exclusion Fee” has been agreed with STORY.

13. Fittings.

Fees for fittings are charged at 50% of the hourly rate and subject to a minimum charge of £80 per hour.

14. Location Bookings.

If a Talent, working on location, is prevented by the client from returning to London to work, half the daily fee is payable. When a location booking is made, the client must provide accurate and detailed information about transport to and from the location.

15. Provisional Bookings.

Provisional bookings are automatically cancelled if they are not confirmed within 24 hours of the proposed start time of the booking, or if a definite booking is offered and the provisional cannot be confirmed.

16. Cancellations.

a. If a booking is cancelled within one working day of its start time, the full fee is chargeable, unless the same Talent is re-booked within 24 hours, in which case, half the fee will be charged.
b. If a booking is cancelled outside the one-day period, but within two working days of the start time, half the fee will be charged.
c. Bookings of more than three days duration: if the booking is cancelled within a period equal to the length of the booking, the full fee is chargeable.
d. Saturdays, Sundays and Bank Holidays are excluded from these calculations.
e. These conditions do not apply to bookings for TV commercials shooting in the
UK, which is governed by Equity rules.

17. Weather Permitting Bookings.

At the first cancellation, a half-fee is charged (unless the client fails to cancel in time to prevent the Talent’s attendance when the full fee will be payable). At the second cancellation, the full fee will be charged.

18. Music Videos & Promotional Films

Music videos will be invoiced to the record company. All videos will be charged at the normal daily rate plus a buyout fee, which must be negotiated with STORY.

19. Photography.

When the Agency agrees to allow a photographer to take test or experimental photography the photographer is not entitled to use, or allow others to use, test and/or experimental photographs or test commercials for commercial purposes unless specific arrangements have been made before the photographic session.

20. Complaints.

Any complaints – whether in respect of the Talent or STORY – must be reported immediately and, in any event, no later than 24 hours after the end of the booking. Complaints cannot be considered after this time. STORY, as agent, whilst making every commercially reasonable endeavour to provide a satisfactory and efficient service, cannot be held responsible for a Talent’s conduct on an assignment.
